Privacy policy

Last updated: October 23, 2026

The Service is operated by The Prop Fund, LLC. Additional terms covering information about people named in property records and cookie choices are included below. To make a privacy request, use our Contact page.

This Privacy Policy explains how The Prop Fund ("we," "us") collects, uses, discloses, and protects information about you when you use our website and services (the "Service"). It forms part of our Terms of Use.

1. Information we collect

Information you provide: name, email, password, phone number, billing details (processed by our payment provider — we do not store full card numbers), saved properties, notes, alerts, data-issue reports, and messages you send us.

Information collected automatically: IP address, device and browser type, pages viewed, searches and filters used, referring URLs, and timestamps, collected through cookies, local storage, and similar technologies.

Property information: the Service displays property and foreclosure information, which may include names of parties associated with a property. This information is not collected from you.

  • Provide, operate, and maintain the Service and your account;
  • Process payments, trials, and subscriptions;
  • Send sale updates, alerts, and service messages you request;

3. How we share information

We do not sell your account information. If advertising cookies are on, Google receives information about your visit, such as pages viewed and your device and browser, to measure our ads; it does not receive your name, email or account details. How paid access to property information is treated is described below in this Policy. We share account information only:

  • with service providers (hosting, payments, email, maps) bound to use it only on our behalf;
  • to comply with law, legal process, or government requests;
  • to protect the rights, property, or safety of The Prop Fund, our users, or others;
  • in connection with a merger, acquisition, financing, or sale of assets; or
  • with your consent.

4. Cookies and tracking

We use cookies and browser storage needed to keep you signed in and remember your preferences. We also use Google Ads cookies to measure our ads and to show our ads to people who have visited the site. You can switch these off on Cookie Preferences, and we do not load them when your browser sends a Global Privacy Control signal. You can also turn off personalized ads at adssettings.google.com. You can control cookies through your browser settings; disabling essential cookies may prevent parts of the Service from working.

5. Data retention

We keep personal information for as long as your account is active and as needed to provide the Service, comply with legal, tax, and accounting obligations, resolve disputes, and enforce agreements. We then delete or de-identify it.

We keep the full IP address recorded at each sign-in for 180 days. Sign-in and device records (the browser and system used, and the network part of the IP address) are kept for up to one year. We use them to enforce one sign-in per account and to detect account sharing and abuse.

6. Security

We use reasonable administrative, technical, and physical safeguards, including encryption in transit. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Your choices and rights

  • Access and update your account information in your account settings.
  • Unsubscribe from marketing emails using the link in each message (service messages may still be sent).
  • Request access to, correction of, or deletion of your personal information by contacting us.

Depending on where you live, you may have additional rights under applicable law. We will not discriminate against you for exercising them. We may need to verify your identity before fulfilling a request.

8. Property data about individuals

Foreclosure and property information is displayed for lawful real-estate research. If you believe a record about you is inaccurate, use "Report a Data Issue" on the property page or contact us. We may be unable to remove information that is lawfully available.

9. Children's privacy

The Service is not intended for anyone under 18, and we do not knowingly collect personal information from children.

Back to contents

10. Third-party links

The Service links to third-party websites such as auction platforms. Their privacy practices are governed by their own policies.

Back to contents

11. Data location

The Service is operated in the United States. Information is processed and stored in the United States.

12. Changes to this policy

We may update this Privacy Policy. Material changes will be posted with a new "Last updated" date and, where appropriate, notified by email.

13. Disputes

Any dispute relating to this Privacy Policy is subject to the binding JAMS arbitration in Atlanta, Georgia, class-action waiver, and governing-law provisions of our Terms of Use.

14. Property Data Privacy: Scope and existing commitments

This supplement explains personal-information practices associated with our foreclosure-data research service. Read it with our existing Privacy Policy. It addresses information about visitors and subscribers, people identified in property-related records, and people whose information is submitted by users or sources.

Compatible existing privacy commitments remain applicable. This supplement does not authorize us to disregard promises made when information was collected or to expand use of previously collected information without legally required notice or consent. Some information from earlier, separately offered investment services may remain subject to separate retention, regulatory, or contractual requirements. Purchasing a data subscription does not itself authorize an investment-account bank connection or collection of accreditation information.

The Company is responsible for the practices it controls; a third party may have separate responsibilities for its independent service.

15. Property Data Privacy: Information you provide

Depending on your interaction, we collect account and business-contact information such as name, email, business affiliation, account credentials or authentication identifiers, and information needed to verify an account; subscription and billing contact information; your selected settings, saved searches, saved-property references, notes, and permitted uploads; and support, correction, feedback, and privacy-request communications.

When optional information is requested, the interface identifies the choice where appropriate. Do not send passwords, full payment credentials, Social Security numbers, health information, or unnecessary identity documents through ordinary notes or support forms. If verification requires additional evidence, we will use a proportionate process appropriate to the request.

Payments are processed by Stripe. Stripe collects your card details directly in its secure payment form; The Prop Fund receives your billing status, plan, renewal dates, and limited card details such as brand and last four digits, but not your full card number.

16. Property Data Privacy: Usage and technical information

We collect technical and activity information needed to operate and protect the service, which may include IP address, browser/device information, access timestamps, authentication/security events, page or feature interactions, search activity, saved preferences, and download/export activity, to the extent actually implemented and disclosed. Location derived from an IP address is approximate. Precise device location is used only if a feature actually requests it and any required permission is obtained.

Cookies, local storage, and similar technologies may support authentication, security, preferences, analytics, or advertising, according to the specific tools enabled. The cookie section below describes the actual optional technologies and choices. A generic privacy paragraph does not mean every possible tracking technology is deployed or authorized.

17. Property Data Privacy: Property and record-subject information

Our research service may contain property addresses, parcel identifiers, ownership or borrower names, mailing details, recorded instruments, notice references, sale information, property characteristics, and other authorized fields relevant to property research.

A record may concern a person who is not a subscriber. A name in a notice is not necessarily the current owner, current occupant, or person with legal responsibility. We distinguish source facts from estimates, interpretations, and user submissions where practicable. We may standardize records and associate related properties/notices, and errors or mismatches can occur.

Public availability may affect how a particular privacy law classifies information, but it does not eliminate every obligation or request right. We do not treat all information associated with a property as automatically outside privacy law.

Back to contents

18. Property Data Privacy: Purposes

We use the information applicable to your interaction to provide accounts, subscription access, property searches and research tools; process payments and billing support; save your selected notes/searches; send requested alerts and necessary service messages; respond to inquiries and correction/privacy requests; maintain source provenance and data quality; prevent fraud, unauthorized extraction, and security threats; diagnose problems and improve performance; enforce lawful agreements and source restrictions; and comply with legal, accounting, and recordkeeping obligations.

We use information for optional marketing, advertising, analytics, or AI processing only as actually disclosed and subject to applicable choices and consent requirements. We do not infer consent to every unrelated use from acceptance of subscription terms. Sensitive or specially regulated information requires a separate applicability and permission assessment.

19. Property Data Privacy: Recipients and disclosure

We disclose information as appropriate to the actual service and applicable law:

  • Service providers performing hosting, authentication, payment processing, communications, mapping, analytics, security, support, and other disclosed operational tasks, under the applicable contractual restrictions.
  • Authorized account users or recipients you direct, limited to the sharing features you choose and their actual access rules.
  • Data Service subscribers receiving property and record information that we are authorized to include in the paid research service. Subscriber access is subject to use and redistribution restrictions; it is not access to other users’ private account notes.
  • Professional advisers and authorities where reasonably necessary for legal compliance, legal process, legitimate rights protection, fraud/security investigation, or protection of safety, subject to law.
  • Parties involved in a proposed or completed merger, financing, reorganization, acquisition, or asset transfer, under appropriate confidentiality/protection arrangements and consistent with existing privacy commitments and required notices.
  • Other recipients when you direct a disclosure or give any required consent.

We do not disclose information indiscriminately merely because a recipient is described broadly as a partner or affiliate. A specific service provider’s independent use is governed by the relevant relationship and notice; the Company will not describe a provider as restricted solely to our instructions if its actual terms allow incompatible uses.

20. Property Data Privacy: Paid record access; sale, sharing, and advertising classifications

The Prop Fund charges subscribers for access to certain property-related information. Whether a particular disclosure is treated as a “sale,” “sharing,” or “targeted advertising” under a privacy law depends on that law, the information, and the actual arrangement. Public-record exemptions do not automatically cover account activity, privately sourced contact details, or inferences.

Where applicable, access the available sale/sharing/targeted-advertising choices through our Contact page and our Cookie Preferences page. We process legally recognized preference signals, including Global Privacy Control where applicable, according to the relevant legal requirements. We do not require identity verification for an opt-out request or preference signal where applicable law prohibits it. Any information needed to associate a choice with the relevant browser, account, or record will be limited and will not create an unlawful barrier.

21. Property Data Privacy: Cookies and similar technologies

Necessary technologies support login, security, fraud prevention, session continuity, and essential settings. Optional technologies, if used, are described by category and purpose in the available Cookie Preferences tool at our Cookie Preferences page. You may manage nonessential choices there, in addition to available browser controls. Blocking necessary storage may affect functionality.

We use browser storage that is necessary to keep you signed in, remember your plan selection, and save display preferences such as table columns. Maps on the Service are provided by Google Maps, which may set its own cookies under Google's policies. We use Google Ads cookies to measure our ads and to show our ads to people who have visited the Service; they are optional and can be switched off in the Cookie Preferences tool. We do not use session-replay tools.

Where consent is required, optional technologies will not be activated before that consent. Withdrawing a choice will apply prospectively and trigger the appropriate controls. Browser “Do Not Track” settings and legally recognized opt-out signals are not necessarily the same. We honor Global Privacy Control by not loading advertising cookies when a browser sends that signal. Mere browsing is not treated as universal consent to optional processing where an affirmative choice is required.

22. Property Data Privacy: User notes, documents, and AI features

Private workspace material is used for the service functions you request and operational purposes described here. Authorized personnel or providers may access it as necessary for requested support, security, legal compliance, or another disclosed operational purpose, with access restrictions appropriate to its sensitivity. “Private” does not mean privileged, immune from lawful process, or accessible only to you under every circumstance.

The subscription terms do not grant an unrestricted license to train general-purpose models on private notes or documents. A materially new use of previously collected information must honor applicable prior commitments, notice, and consent requirements. If we create properly deidentified or aggregated information, we maintain safeguards appropriate to the applicable standard and do not claim that removing a name alone guarantees anonymity.

Back to contents

23. Property Data Privacy: Retention

We retain personal information for the period reasonably necessary for the stated purpose, consistent with applicable law and source contracts. We evaluate account/service needs, billing and tax obligations, fraud and security risks, unresolved disputes, legal holds, privacy-request records, available historical-research features, and source-license limits.

When information is no longer needed and no exception applies, we delete, deidentify, or otherwise dispose of it appropriately. Backup removal may follow the documented rotation cycle, with restrictions on reuse and reapplication of required deletions if data is restored. We do not promise immediate erasure from every backup or from independently controlled third-party copies.

Back to contents

24. Property Data Privacy: Security and incidents

We use reasonable administrative, technical, and organizational measures appropriate to the information and risks. No internet service or security measure is guaranteed to prevent every incident. Specific certifications, audits, encryption claims, or security features are described only when actually supported.

We assess suspected incidents and provide notifications required by applicable law. The timing, recipients, and content depend on the governing requirements and incident facts. This statement does not promise that every incident will be reported to every person within a single fixed deadline, or waive a duty that applies to the Company or a provider.

25. Property Data Privacy: Your choices and requests

Use our Contact page or The Prop Fund through our Contact page to contact us about access, correction, deletion, privacy choices, or a disputed property record. You do not need a paid account to make a request. A person may have rights based on residence, applicable law, and our processing activities, including access/confirmation, correction, deletion, portability, restrictions or opt-outs concerning specified uses, and appeal of a denial where provided by law.

We will evaluate applicable rights and exceptions, verify identity or authority proportionately when legally permitted and needed, and respond within the applicable legal timeframe. We do not require identity verification for sale/sharing opt-outs or recognized preference signals where applicable law prohibits it. We may request enough information to locate a record and protect against unauthorized disclosure when appropriate to the request; we do not require unnecessary sensitive identifiers as a routine condition. Where applicable, an authorized agent may act for you after any legally permitted authority or identity checks appropriate to that request. Mandatory requests are not conditioned on payment, arbitration, agreement to new terms, or surrender of another legal right.

If we deny or limit a request, we will explain the applicable basis and any available appeal/complaint route. We will not unlawfully discriminate for exercising a privacy right. A request concerning government-source information may require contacting the source separately; correcting our display does not change the original government record. We will consider lawful suppression/correction duties even if an underlying record remains public.

If we are subject to a jurisdiction-specific privacy or data-broker regime, the applicable supplemental notice and request process provide the additional required categories, methods, timelines, and rights. We do not assume Georgia-only property coverage removes obligations involving people in other states.

26. Property Data Privacy: Communications

You may unsubscribe from promotional email using its unsubscribe link and manage optional property/search notifications in your account. Necessary security, transaction, and legal messages may still be sent where appropriate. Unsubscribing from marketing does not itself cancel a paid subscription; cancellation is available through our Cancel Subscription page.

Marketing calls or texts, if offered, use a separate consent process where required. We retain appropriate records of choices and honor legally required revocations. We do not treat a publicly displayed phone number or a general terms checkbox as blanket consent to contact a person.

Back to contents

27. Property Data Privacy: Children; geography; external services

The Data Service is intended for adults and professional or personal property research. We do not knowingly solicit account registrations from children under 18. If we learn that information has been collected or disclosed in a manner requiring action under a law protecting children or minors, we will address it appropriately. An age restriction does not eliminate statutory duties.

The service is operated for the disclosed markets. A link to a source, map, payment page, or external auction provider may take you to a service with its own privacy practices. Review the relevant notice; third-party independence does not excuse our responsibility for disclosures we make.

Back to contents

28. Property Data Privacy: Changes and contact

We will identify the effective date of changes and provide notice appropriate to their significance. A materially new use or disclosure will receive any legally required notice and consent before implementation. We will not rely on a hidden retrospective policy change to expand use of information collected under a more restrictive promise.

Contact The Prop Fund, LLC at The Prop Fund through our Contact page, our Contact page, or The Prop Fund through our Contact page. Additional applicable state-rights notices are linked from this page. Prior published versions remain available where appropriate to explain the commitments applicable to earlier collection.
