Data disclaimer

Important — please read
The Prop Fund does not warrant, guarantee, or certify the accuracy, completeness, timeliness, or reliability of any information or data on this website. All data is presented to the best of our ability and is provided "AS IS" and "AS AVAILABLE," with all faults. You are solely responsible for independently verifying every piece of information before relying on it for any purpose.
1. No warranty or guarantee
To the fullest extent permitted by law, The Prop Fund disclaims all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, title, and non-infringement. No information obtained from The Prop Fund creates any warranty not expressly stated in our Terms of Use.
Data may be incomplete, out of date, mis-transcribed, mis-matched to the wrong property, or simply wrong. Errors may exist in the data and in our display of it.
2. Best-efforts presentation
We make reasonable efforts to present information clearly, but we cannot confirm that it is correct. A "Last checked" date shows when we last reviewed a record, not that the record is still accurate.
3. Foreclosure sales and statuses
Foreclosure sales are frequently postponed, cancelled, reinstated, or resolved through bankruptcy, loan modification, or payoff — often without public notice and sometimes on the morning of the sale. A displayed sale date, time, location, opening bid, or status may not reflect what actually happens.
A passed sale date does not mean the property sold. The Prop Fund does not conduct auctions, accept bids, or accept any purchase funds.
4. Estimates and valuations
The Prop Fund Estimate and any third-party estimates (such as Zillow, Redfin, Realtor, Trulia, or an auction site's own estimate) are automated approximations. They are not appraisals, broker price opinions, or offers, and they do not account for property condition, occupancy, repairs, or title issues. Actual values may be significantly higher or lower.
5. Title, liens, and lis pendens
Lien, lis pendens, deed, and loan information is shown for research only and may be incomplete. We do not show lien balances or determine lien priority, survival after sale, or marketable title. The Prop Fund is not a title search, title insurance, or a legal opinion. Always obtain a professional title examination before bidding or purchasing.
6. Property page details
- Sale information and property records can change. Independently verify the details. The Prop Fund does not conduct auctions or accept bids.
- Bids, estimates, assessed values, and debt describe different things. Estimates are not appraisals or guarantees.
- The Estimated Opening Bid and its range are The Prop Fund's own estimates, not the lender's figures. The actual opening bid may fall outside them.
- Lien balances are not shown. Independently verify before relying on any record.
- Owner, occupancy, and deceased information may be outdated or incomplete.
7. Not professional advice
Nothing on The Prop Fund is legal, financial, tax, investment, real estate, or appraisal advice. Consult a licensed Georgia attorney, title professional, appraiser, or financial advisor before making decisions.
8. Photos
Photos may be representative images and may not depict the actual property.
9. Limitation of liability
The Prop Fund and its owners, and employees are not liable for any loss or damage — including lost profits, lost deposits, or purchase of a property with unknown defects or encumbrances — arising from your use of or reliance on any information on this website. See our Terms of Use for the full limitation of liability and arbitration terms.
10. Reporting errors
If you find an error, use the "Report a Data Issue" button on the property page. Reports are reviewed but we are not obligated to make any correction.
11. Supplement: Informational research service
The Prop Fund provides property and foreclosure information for research. It is not an official government record system, the official legal publication for a county, a title insurer, an appraisal, or an auction-sale guarantee. The Company is not the seller, owner, trustee, foreclosing party, auctioneer, broker, lender, attorney, or representative of a listed property merely because a record appears here.
12. Supplement: Coverage and completeness
Statewide access means access to the available service across Georgia’s counties. It does not mean that every possible record, notice, lien, sale, postponement, cancellation, historical event, image, or field is present. Data availability and update timing vary. A zero-result search can mean no matches under the selected criteria and does not prove no foreclosure activity exists. Check source-coverage notices for known gaps.
13. Supplement: Dates and status
Information may be incomplete, delayed, duplicated, mismatched, incorrectly transcribed, or superseded. Publication date, effective/as-of date, import time, last check, and scheduled sale date are distinct. “Updated” may refer to a platform change and does not automatically mean every underlying fact was newly confirmed. A “verified” label, if used, describes the specific check identified with it and is not a guarantee of legal accuracy or future events.
A property may have multiple cases or repeated notices. A scheduled date passing does not establish that a sale occurred. “Outcome unconfirmed” means we lack an accepted source confirming the result; it does not mean sold, cancelled, or available for purchase. Even a reported sale outcome may require further documentation or may later be affected by legal proceedings.
Listings are archived at 5:00 PM Eastern on their advertised sale date and then leave search, maps, saved lists and exports. Your own notes stay in your account. Exports and copies made earlier are snapshots.
14. Supplement: Sale dates, locations, and participation
Dates, times, locations, organizers, terms, bidding methods, deposits, payment deadlines, and eligibility can change. A county auction-location directory, directions link, countdown, or calendar is a research aid. It does not replace the operative notice and confirmation with the responsible party for the particular event. General monthly sale patterns must not be substituted for the advertised date and applicable exceptions.
Confirm the sale’s status and requirements directly before attending, sending funds, arranging financing, or bidding. The Prop Fund does not register a bid, reserve a place, hold money, or satisfy an organizer’s requirements through a saved property or calendar entry. An external link is not a guarantee that bidding remains available.
15. Supplement: Identity, ownership, and occupancy
A person named in a notice, deed, loan record, or other source may not be the current owner, borrower, occupant, authorized seller, or person responsible for a debt. A match based on a name or address can be incorrect. Information is not a finding of wrongdoing or proof of financial distress, legal liability, incapacity, death, or current default.
Do not assume that a property is vacant or accessible. An image or listing does not grant permission to enter, inspect, photograph from restricted property, remove belongings, contact occupants improperly, or take possession.
16. Supplement: Financial figures and estimates
Original loan amount, outstanding debt, advertised opening bid, winning bid, reported sale price, appraised value, assessed value, and estimated market value are different measurements. An original loan amount is not a current payoff, and an opening bid is not a guaranteed purchase price. Missing amounts are unknown, not zero.
Estimated market values, comparable-property analyses, rent figures, projected costs, equity calculations, returns, scores, and underwriting scenarios, when offered, depend on assumptions and may omit material costs, liens, taxes, repairs, financing constraints, or market changes. They are not appraisals, payoff statements, tax determinations, personalized recommendations, or guarantees. User-entered assumptions remain user assumptions.
17. Supplement: Title, liens, legal proceedings, and possession
The Data Service does not establish marketable or insurable title, lien priority, extinguishment of liens, compliance with notice/service requirements, sale validity, the absence of bankruptcy or litigation, the existence or expiration of redemption rights, or the right to immediate possession. Taxes, association assessments, federal interests, senior liens, municipal charges, leases, occupancy rights, and other interests may require investigation.
Mortgage foreclosures, tax sales, judicial sales, bankruptcy sales, and bank-owned resales follow different rules. A field or general guide for one process must not be assumed to apply to another. Obtain appropriate independent review of the actual documents and circumstances.
18. Supplement: Property condition, images, and geography
Photos, maps, parcel outlines, geocodes, street views, and physical characteristics may be outdated, approximate, incomplete, or associated incorrectly. A map pin is not a survey or boundary determination. Images may not show current condition, damage, access restrictions, code problems, environmental conditions, improvements, or occupancy. Confirm important physical and location facts independently.
A placeholder or illustration is not a photograph of the property. Demo and illustrative material is labeled accordingly and should not be relied on as evidence of the actual property or its condition.
19. Supplement: Automated tools and summaries
Automated extraction, matching, calculations, translations, summaries, and AI-assisted features can produce errors, omit qualifying language, or associate unrelated records. Independently verify material matters. We do not guarantee the accuracy of an automated explanation merely because it reads confidently. No automated feature independently establishes legal rights, ownership, creditworthiness, or investment suitability.
20. Supplement: Alerts, exports, and historical information
Alerts can be delayed, blocked, duplicated, or unavailable, and may not include every change. Exports and screenshots are snapshots that can become stale after download. Historical records describe the information at a prior time; a historical notice should not be interpreted as current status. Retain source/date context and recheck material details before acting.
21. Supplement: Prohibited personal eligibility use; contact limits
The Data Service is intended for property and market research. It is not offered for deciding a person’s eligibility for credit, insurance, employment, housing/tenancy, or another purpose governed by the Fair Credit Reporting Act. Such use is prohibited. A label or disclaimer alone does not remove any legal duty that arises from the Company’s actual activities or a user’s conduct.
Publication of a person’s contact information is not consent to call, text, email, solicit, collect a debt from, or otherwise contact that person. Users must comply with applicable law and permissions, and must not harass, deceive, discriminate against, or impersonate others.
22. Supplement: No professional advice; no guaranteed outcome
General guides, customer support, data fields, and research tools are not a substitute for legal counsel, a title examination, an appraisal, inspection, tax advice, financing review, or your independent judgment. The Company does not guarantee that a property is a sound investment, that a transaction can close, that a sale will occur, or that an opportunity will produce a profit. You can lose money in a real estate transaction.
23. Supplement: Corrections and legal limits
Report a suspected error or privacy concern through “Report a Data Issue,” our Contact page, or The Prop Fund through our Contact page. Include the property/record reference and the field at issue without sending unnecessary sensitive information. We will address requests under the applicable policies and legal duties. We cannot promise to alter independent source records or every third-party copy.
This Disclaimer supplements the Terms and does not create a separate liability cap or dispute procedure. All lawful limitations remain subject to the integrated Terms’ exceptions for fraud, gross negligence, willful misconduct, and nonwaivable legal duties/remedies. This notice does not excuse knowing false statements or permit us to disregard legally required correction, security, privacy, or consumer-protection obligations.
